Environmental impunity: the state between differential management of illegalisms and global withdrawal
L'impunité environnementale : l'État entre gestion différentielle des illégalismes et désinvestissement global

This paper attempts to explain the persistent impunity which prevails in the environmental field in a context paradoxically marked by a tightening of the legal framework. Focusing on the judicial, and in particular penal, treatment of environmental illegal practices, it highlights five main factors: the lack of resources of environmental police; the compromises with some interest groups; the judicial doctrine leading preferentially, in this particular field, to transactional procedures; the disconnection of magistrates from environmental issues; and the weak coordination between the local actors of environmental penal policies. In the end, this article shows that the state oscillates between a differential management of illegal practices and a global disinvestment.
Cet article cherche à rendre compte de l'impunité persistante qui règne en matière d'environnement dans un contexte marqué, paradoxalement, par un durcissement tendanciel du cadre juridique. Se focalisant sur le traitement judiciaire, et notamment pénal, des illégalismes environnementaux, il met en avant cinq principaux facteurs : le manque de moyens des polices de l'environnement ; le ménagement de certains groupes d'intérêt ; la doctrine judiciaire conduisant à privilégier, dans ce domaine, les procédures transactionnelles ; la déconnexion des magistrats par rapport aux questions environnementales ; la faible coordination entre les acteurs locaux des politiques pénales environnementales. En fin de compte, cet article met en lumière un État oscillant entre gestion différentielle des illégalismes et désinvestissement global.
