Les pratiques contractuelles foncières dans une économie en transition. Le cas d'Alba en Roumanie

Abstract : The emergence of a land rental market in Romania occurs in a transition context characterized by several market imperfections. The literature in development economics has recently stressed the role of land tenancy in improving efficiency and equity of land allocation when other markets are imperfect. This dissertation deals with the development of the land rental market in Romania. The purpose of the research is to identify the determinants of land contractual practices. Our analysis relies on insights from economic theories of agrarian contracts developed in the New Institutional Economics framework. From a methodological point of view, we adopt a comprehensive approach, completed by a formal analysis of quantitative data. The research is based on a fieldwork conducted in 2003 and 2004 in two municipalities in the district of Alba, Transylvania. We show that land tenancy allows actors to face the market imperfections and the high uncertainty linked to the transition process. However, the adjustment realized through the land rental market is constrained by transaction costs. The positive effect of land tenancy on equity is questionable, as the main actors of the land demand, large-scale corporate farms, are in such a position they can choose and adjust ex post the contract terms, when any enforcement device is lacking.
